Partnership Terms and Conditions

As a Tourism East partner, you’re part of a shared commitment to growing a strong and sustainable visitor economy across the Yarra Valley and Dandenong Ranges.

We value collaborative relationships that create genuine benefits for both our partners and the destination. The terms below outline what you can expect from your partnership with Tourism East, as well as the commitments we ask of you to help us maintain a high-quality, professional tourism industry.

By becoming a Tourism East partner, you agree to the following terms and conditions:

1. Partnership Overview

Tourism East partnerships provide businesses with opportunities to connect with industry, access resources and insights, and participate in marketing and promotional activities that support visitation to the Region.

Our partnerships are built on collaboration, transparency and shared goals, with a focus on strengthening the region’s visitor economy and delivering value for both our partners and the destination.

Please note: Tourism East partners may be referred to as ‘members’ where information or invoices are generated through our customer management system. This terminology is used for administrative purposes only and does not provide any additional membership rights to an individual or business.

2. Eligibility Criteria

To participate in the Tourism East Partnership Program, your business or organisation must:

  • Be located in, or operate within, the Tourism East region. Businesses located outside the region may be considered at the discretion of Tourism East where their activities provide a clear benefit to the regional visitor economy.
  • Comply with all relevant Australian laws, regulations, licences, permits and industry requirements applicable to your business, including those relating to health and safety, food safety, responsible service of alcohol, transport and events.
  • Hold public liability insurance of at least $10 million, where applicable to your business.
  • Provide quality products or services that align with the values of responsible and sustainable tourism.
  • Understand that membership or partnership with another tourism or industry association does not automatically entitle that association’s members to individual Tourism East partnership benefits.

Tourism East reserves the right to determine eligibility for partnership and may decline or review a partnership where a business does not meet these requirements.

3. Partnership Categories

Tourism East offers a range of partnership levels designed to suit different businesses and organisations.

Partnership benefits, inclusions and pricing are outlined in the current Tourism East Partnership Guide and on the Tourism East website. Benefits may vary according to the partnership level selected and may be subject to availability, campaign requirements and Tourism East priorities.

Tourism East reserves the right to determine how and when partnership benefits are delivered to achieve the greatest benefit for the destination and our partners.

4. Promotion & Marketing

Depending on your partnership level, your business may have access to a range of Tourism East marketing and promotional opportunities, including:

  • Website: Inclusion on Tourism East consumer websites and relevant destination listings, where included in your partnership.
  • Social media: Promotional opportunities across Tourism East social media channels, subject to content suitability, campaign priorities and available opportunities.
  • Email marketing: Inclusion in Tourism East consumer email communications, where relevant and included in your partnership.
  • Campaigns and promotions: Opportunities to participate in destination marketing campaigns, promotions and other initiatives.
  • Industry activities: Access to relevant Tourism East networking, training and industry development opportunities.

We encourage partners to keep Tourism East informed of new products, experiences, special offers, events and other relevant developments so we can identify suitable opportunities to share your content.

Tourism East does not guarantee that a particular business, product or service will be featured, promoted or included in any specific campaign or communication.

While we take reasonable care to ensure information published through our channels is accurate, Tourism East does not guarantee that all information, including business descriptions, pricing, availability, offers or other details, will be free from errors or omissions. Partners are responsible for ensuring the information they provide is accurate and current.

Tourism East is not responsible for third-party websites, platforms, content, products or services accessed through links on Tourism East websites or marketing channels.

5. Partner Responsibilities

To help us deliver a successful partnership, partners agree to:

  • Provide accurate, complete and up-to-date information for listings, campaigns and promotional activity.
  • Ensure all images, content and other materials supplied to Tourism East are accurate and that you have the necessary rights and permissions for their use.
  • Comply with reasonable marketing and content requirements provided by the Tourism East team.
  • Maintain appropriate standards of customer service and ensure your products and services meet visitor expectations.
  • Notify Tourism East of any changes to your business that may affect your listing, eligibility or partnership benefits.
  • Where applicable, maintain and update your Australian Tourism Data Warehouse (ATDW) listing.
  • Support the promotion of the Yarra Valley and Dandenong Ranges through your own marketing and communication channels where appropriate.
  • Understand that Tourism East does not guarantee specific levels of website traffic, social media engagement, enquiries, bookings, visitation, revenue or return on investment from partnership activities.
  • Understand that Tourism East is not responsible for independently tracking or attributing bookings, sales or other commercial outcomes generated through partnership activity.

6. Fees & Payment

An active Tourism East partnership is required for inclusion in Tourism East marketing and promotional activities where partnership is specified as a requirement.

  • Partnership fees are payable in accordance with the agreed payment terms.
  • Each partner will have one debtor account for financial and invoicing purposes.
  • Partnership fees are non-refundable once paid, including where a business closes, changes ownership or ceases trading, unless otherwise agreed in writing by Tourism East.
  • Outstanding accounts may result in the suspension or removal of partnership benefits and may trigger a review of the partnership.
  • Additional promotional activities, services or opportunities not included in the selected partnership package may incur additional fees. These costs will be confirmed before the service is delivered and must be paid in accordance with the agreed payment terms.
  • Tourism East reserves the right to take appropriate action to recover outstanding amounts.

7. Use of Tourism East Branding

Partners may be granted a limited, non-exclusive licence to use Tourism East logos, branding and approved assets during the period of their partnership.

Any use must comply with Tourism East brand guidelines and any reasonable requirements provided by the Tourism East marketing team.

Tourism East may require approval of proposed uses of its branding before publication or distribution.

The right to use Tourism East branding ceases when the partnership ends or is terminated.

8. Term & Termination

Partnerships operate for a 12-month period, unless otherwise agreed in writing.

Either party may request to terminate a partnership by providing written notice. Partnership fees already paid are non-refundable unless otherwise agreed by Tourism East.

Tourism East may suspend or terminate a partnership where a partner:

  • breaches these Terms & Conditions;
  • fails to meet eligibility requirements;
  • fails to pay outstanding fees;
  • engages in unlawful, unethical or inappropriate conduct; or
  • acts in a way that Tourism East reasonably considers may adversely affect the reputation of Tourism East or the Yarra Valley and Dandenong Ranges visitor economy.

Where appropriate, Tourism East may provide an opportunity for the partner to address the issue before termination.

9. Liability & Indemnity

Partners are responsible for their own business operations, products, services, employees, contractors and customers.

Partners agree to indemnify Tourism East against claims, losses, damages, liabilities, costs or expenses arising from the partner’s business activities, products or services, or participation in Tourism East activities, except to the extent caused by Tourism East’s negligence or misconduct.

Tourism East does not guarantee any particular commercial outcome from partnership participation and is not responsible for indirect or consequential loss arising from participation in the Partnership Program.

10. Privacy & Data Protection

Tourism East collects and uses business and personal information provided by partners to administer partnerships, communicate with partners, deliver partnership benefits and support destination marketing and visitor economy activities.

Information will be handled in accordance with applicable Australian privacy legislation and Tourism East’s privacy policy.

Where information is shared with third parties, Tourism East will do so where reasonably required to deliver partnership services, marketing activities or other agreed purposes, or where required or permitted by law.

11. Dispute Resolution

We encourage partners to raise any concerns or disputes with Tourism East as soon as possible so they can be addressed constructively.

Both parties agree to make reasonable efforts to resolve disputes in good faith.

If a dispute cannot be resolved directly, it will be dealt with in accordance with applicable Australian law.

12. Changes to the Terms & Conditions

Tourism East may update these Terms & Conditions from time to time to reflect changes to our partnership program, operations, legislation or industry requirements.

Where a change materially affects existing partnership arrangements, Tourism East will provide reasonable notice to partners.

The current version of these Terms & Conditions will be made available through the Tourism East website and will apply to partnerships from the date specified.
